These terms govern your use of Zamili.ai and our services.
1. Acceptance of Terms
By accessing or using Zamili.ai ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
These Terms constitute a legally binding agreement between you and Zamili.ai ("we," "us," or "our"). Your use of the Service is also subject to our Privacy Policy, which is incorporated by reference.
2. Description of Service
Zamili.ai is an AI-powered automation platform that provides social media management, email automation, workflow creation, and analytics services. Our Service allows you to:
- Connect and manage Instagram and Facebook accounts
- Connect and manage Gmail accounts for email automation
- Create automated workflows for responding to comments, DMs, and other events
- Send automated emails through Gmail
- Track links and analyze engagement metrics
- Generate analytics and insights reports
3. Third-Party OAuth Integrations
3.1 Meta (Instagram/Facebook) OAuth Integration
Our Service integrates with Meta's platforms (Instagram and Facebook) through OAuth 2.0 authentication. By connecting your Meta accounts, you agree to the following:
- Authorization: You grant us permission to access your Instagram and/or Facebook accounts through Meta's OAuth API.
- Scope of Access: We request the following permissions:

- Deauthorization: You can disconnect your Meta accounts at any time through our dashboard or by revoking access through Meta's platform settings.
- Webhook Compliance: We maintain webhook endpoints for Meta deauthorization and data deletion requests as required by Meta's Platform Terms.
Important: You are responsible for ensuring your use of our Service with Meta accounts complies with Meta's Terms of Service, Community Guidelines, and applicable laws. We are not responsible for any violations of Meta's policies that may result from your automated workflows.
3.2 Google/Gmail OAuth Integration
Our Service integrates with Google's Gmail API through OAuth 2.0 authentication. By connecting your Gmail account, you agree to the following:
- Authorization: You grant us permission to access your Gmail account through Google's OAuth API.
- Scope of Access: We request the following OAuth scopes:

- Limited Use: We only use the Gmail API to:
- Send emails as configured in your automation workflows
- Access your email address for account identification and management
We do NOT read, modify, delete, or access any emails in your inbox. We only send emails on your behalf.
- Compliance: Our use of Google's APIs complies with:
- Google's API Services User Data Policy
- Google's Gmail API Terms
- Google's Privacy Policy
- Data Handling: We store OAuth tokens (access tokens and refresh tokens) securely and encrypted. We implement proper token refresh mechanisms to maintain access.
- Revocation: You can disconnect your Gmail account at any time through our dashboard or by revoking access through Google Account Settings.
- Token Management: We automatically refresh expired tokens when possible. If token refresh fails, you may need to reconnect your account.
Important: You are responsible for ensuring your use of our Service with Gmail complies with Google's Terms of Service, Gmail Program Policies, and applicable laws (including anti-spam laws). You must not use our Service to send spam, phishing emails, or any other illegal or prohibited content.
3.3 General OAuth Terms
- Security: You are responsible for maintaining the security of your accounts and access credentials. We are not liable for unauthorized access to your third-party accounts.
- Account Responsibility: You represent and warrant that you own or have the legal right to use any third-party accounts you connect to our Service.
- Third-Party Terms: Your use of third-party platforms (Meta, Google) is also subject to their respective terms of service, privacy policies, and community guidelines.
- Service Availability: Our Service depends on third-party APIs. We are not responsible for service interruptions, changes, or limitations imposed by Meta, Google, or other third-party providers.
- API Changes: Third-party platforms may change their APIs, terms, or permissions. We will make reasonable efforts to adapt, but we cannot guarantee continued compatibility.
4. User Accounts and Registration
- You must provide accurate, current, and complete information when creating an account
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorized access or security breach
- Age Requirement: You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Service. By using the Service, you represent and warrant that you meet this age requirement
- One person or entity may not maintain more than one account without written permission
- You may not share your account credentials with others or allow others to access your account
- You are responsible for all activities that occur under your account
- We reserve the right to suspend or terminate accounts that violate these Terms
5. Acceptable Use
You agree NOT to:
- Use the Service for any illegal purpose or in violation of any laws
- Send spam, phishing emails, or unsolicited messages through our Service
- Violate any third-party rights, including intellectual property rights
- Use automated systems to access the Service in a way that exceeds reasonable usage
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the Service or servers
- Use the Service to transmit viruses, malware, or other harmful code
- Violate Meta's, Google's, or any other third-party platform's terms of service
- Create workflows that violate platform policies (e.g., Instagram Community Guidelines, Gmail Program Policies)
- Use the Service to harass, abuse, or harm others
5.1 Prohibited Content
You agree NOT to use the Service to send, publish, or distribute:
- Content that is illegal, harmful, threatening, abusive, or discriminatory
- Content that violates intellectual property rights
- Spam, unsolicited commercial messages, or bulk messaging
- Phishing attempts or fraudulent content
- Content containing malware, viruses, or malicious code
- Adult content, explicit material, or content inappropriate for minors
- Content that promotes violence, hate speech, or terrorism
- Content that violates any applicable laws or regulations
5.2 Rate Limiting and Fair Use
- We implement rate limiting to ensure fair use and prevent abuse
- Your subscription plan includes specific limits on workflows, automation rules, and executions
- Exceeding your plan's limits may result in service restrictions or suspension
- We reserve the right to throttle or limit API requests to prevent system abuse
- Attempting to circumvent rate limits is a violation of these Terms
- We may temporarily suspend accounts that exhibit abusive usage patterns
6. Workflows and Automation
When creating automation workflows, you agree that:
- You are solely responsible for the content and actions performed by your workflows
- All automated messages and emails comply with applicable laws and platform policies
- You have the right to send messages/emails to the recipients you configure
- You will not use automation to spam, harass, or mislead users
- We reserve the right to suspend or disable workflows that violate these Terms or platform policies
- We are not liable for any consequences resulting from your automated workflows
7. Subscription and Payment
7.1 Subscription Plans
- Some features may require a paid subscription
- Subscription fees are billed in advance on a recurring basis (monthly or yearly)
- You authorize us to charge your payment method for subscription fees
- We reserve the right to change pricing with 30 days' notice
- Failure to pay may result in suspension or termination of your account
7.2 Free Trial Period
- New users may be eligible for a free trial period as specified at registration
- Trial periods are limited to one per user and cannot be extended or renewed
- During the trial period, you have access to limited features as specified in your plan
- If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan
- We reserve the right to modify or discontinue trial offers at any time
- Trial accounts are subject to the same Terms of Service as paid accounts
7.3 Refund Policy
- No Refunds: Subscription fees are non-refundable except as required by law or as explicitly stated below
- Partial Periods: Refunds are not provided for partial billing periods after cancellation
- Service Issues: If the Service is unavailable for more than 48 consecutive hours due to our error, you may request a prorated refund for that period
- Billing Errors: If we make a billing error, we will correct it and refund any overcharges
- Chargebacks: Initiating a chargeback or payment dispute may result in immediate account suspension or termination
- Refund Requests: All refund requests must be submitted within 7 days of the charge date to billing@zamili.ai
7.4 Payment Processing
- Payments are processed through third-party payment processors (e.g., Stripe)
- You agree to provide accurate payment information and authorize us to charge your payment method
- You are responsible for any fees charged by your payment provider
- We reserve the right to refuse or cancel any subscription at our discretion
8. Intellectual Property
- The Service and its content are owned by Zamili.ai and protected by copyright, trademark, and other laws
- You retain ownership of content you create or upload
- By using the Service, you grant us a license to use, store, and process your content to provide the Service
- You may not copy, modify, or create derivative works of the Service without permission
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZAMILI.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
WE ARE NOT RESPONSIBLE FOR:
- Third-party platform outages, API changes, or service limitations (Meta, Google, etc.)
- Content or actions created by your automated workflows
- Unauthorized access to your accounts
- Data loss or corruption
- Interruptions or errors in the Service
10. Indemnification
You agree to indemnify, defend, and hold harmless Zamili.ai and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content or actions created by your workflows
- Your violation of Meta's, Google's, or any other platform's terms of service
11. Termination
11.1 Termination by You
- You may terminate your account at any time through your account settings
- You may cancel your subscription at any time, which will take effect at the end of your current billing period
- Upon termination, your right to use the Service immediately ceases
11.2 Termination by Us
- We may suspend or terminate your account at any time for violation of these Terms
- We may suspend accounts immediately for:
- Violation of these Terms or third-party platform policies
- Suspected fraudulent activity or payment issues
- Abusive usage patterns or system abuse
- Legal or regulatory requirements
- We will provide notice of termination when possible, except in cases of severe violations
- We may delete your data upon termination, subject to our Privacy Policy and legal obligations
- Provisions that by their nature should survive termination will survive
11.3 Effect of Termination
- Upon termination, all licenses and access rights immediately cease
- You remain responsible for any charges incurred before termination
- We are not obligated to retain or provide your data after termination
- You may request data export before termination (see Section 12)
12. Data Deletion and Account Removal
12.1 Data Export
- You may request an export of your data at any time by contacting privacy@zamili.ai
- We will provide your data in a machine-readable format within 30 days of your request
- Data exports include: workflow configurations, automation rules, execution logs, and account settings
- Third-party OAuth tokens and credentials are not included in exports for security reasons
12.2 Data Deletion
Upon account deletion or termination, we will:
- Delete or anonymize your personal data as described in our Privacy Policy
- Disconnect and remove OAuth connections to third-party accounts (Meta, Google)
- Delete workflow configurations and automation rules
- Delete execution logs and analytics data
- Retain certain data as required by law or for legitimate business purposes (e.g., transaction records, legal compliance)
You can request data deletion by contacting us at privacy@zamili.ai or through your account settings.
12.3 Data Retention
- We retain transaction and billing records as required by law (typically 7 years)
- We may retain anonymized usage data for analytics and service improvement
- Backup copies of data may be retained for up to 90 days after deletion
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on this page
- Updating the "Last Updated" date
- Sending you an email notification (for significant changes)
- Displaying a notice on our website
Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions.
Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in Dubai, UAE, in accordance with the rules of the Dubai International Arbitration Centre (DIAC).

16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Service Availability and Modifications
17.1 Service Level
- We strive to maintain high availability but do not guarantee uninterrupted or error-free service
- The Service may be temporarily unavailable due to maintenance, updates, or unforeseen circumstances
- We are not liable for service interruptions, delays, or failures
- We reserve the right to modify, suspend, or discontinue any part of the Service at any time
17.2 Beta and Experimental Features
- Some features may be labeled as "beta," "experimental," or "preview"
- Beta features may be unstable, incomplete, or subject to change without notice
- We make no warranties regarding beta features and they are provided "as-is"
- We may discontinue beta features at any time without notice
- Use of beta features is at your own risk
17.3 Service Modifications
- We reserve the right to modify, update, or discontinue features at any time
- We will provide reasonable notice for significant changes that affect core functionality
- We are not obligated to maintain backward compatibility with previous versions
- Continued use of the Service after modifications constitutes acceptance of changes
18. Force Majeure
We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, acts of God, or extreme weather conditions
- War, terrorism, riots, or civil unrest
- Government actions, regulations, or restrictions
- Internet or telecommunications failures or outages
- Third-party service provider failures (Meta, Google, payment processors, hosting providers)
- Pandemics, epidemics, or public health emergencies
- Labor strikes or disputes
- Cyberattacks, security breaches, or data breaches affecting third-party services
In the event of a force majeure, we will make reasonable efforts to resume service as soon as practicable.
19. Disclaimers
19.1 AI-Generated Content
- Our Service may use AI technologies for content moderation, analysis, or generation
- AI-generated content may contain errors, inaccuracies, or inappropriate content
- You are responsible for reviewing and approving all AI-generated content before use
- We make no warranties regarding the accuracy, completeness, or appropriateness of AI-generated content
- You agree not to hold us liable for any consequences resulting from AI-generated content
19.2 Third-Party Services
- Our Service integrates with third-party platforms (Meta, Google, Stripe, etc.)
- We are not responsible for the availability, accuracy, or functionality of third-party services
- Third-party platforms may change their APIs, terms, or policies at any time
- We make no warranties regarding third-party integrations
- Your use of third-party services is subject to their respective terms and policies
19.3 No Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Zamili.ai regarding the Service and supersede all prior agreements and understandings.
